Its a good decision to get your Pool Compliance Certificate.  Check the NSW Government website https://www.swimmingpoolregister.nsw.gov.au/inspections for a list of authorised pool certifers in your area.  

What is the Building Professionals Board?

In NSW, the BPB are the administrators of the Building Professionals Act 2005 and issues practice advice to councils and certifiers on the certification system. In particular, the BPB:

  • Administer the accreditiation process under the BP Act 2005 and the accreditation scheme;
  • requires certifiers to adhere to the code of conduct contained in the scheme;
  • facilitates continuing development for Accredited Certifiers - to be undertaken each year in order to renew accreditation;
  • monitors the activities of Certifiers through the complaints received;
  • provides advice to consumers about the certification system;
  • operates an inquiry line for consumers and practitioners about the certification system and the boards accreditation and monitoring functions;
  • provides practice advice to certifiers and councils on the certification system through its website and quarterly BPBulletin and
  • consults industry, local government and others on ways to improve the certification system.

Building professionals came together in our area to discuss issues effecting not only our practices but the timley delay of approvals for the constituants of the community. There are some great reforms in the pipeline in regards to complying development and a robust discussion regarding education and training was had. Thanks to Tweed Shire Council and the Building Professionals Board for organising this much needed discussion.

Should You Use a Private Certifier?

Most projects requiring building works in NSW have two options for obtaining approvals. The first option is to apply to your local council. The second option is to call a private certifier.  Private Certification is a growing service, encouraged by the NSW government as a way to ease congestion and aviod major delays during the approval process for building projects across the state.  Private certifiers will assess your plans and guide you through the intricate web of State and Local planning legislation to help you to obtain the approval necessary for your situation. Private Certification fees are comparable to council fees, its just another option available to the people of NSW.

Compliance, sale and lease provisions

Changes to the Swimming Pools Act 1992 will take full effect from 29 April 2016, affecting swimming pool compliance and property transactions.

New 'certificate of non-compliance'

From 29 April 2016, properties sold with a pool must have a relevant occupation certificate, certificate of compliance, or a certificate of non-compliance.

The certificate of non-compliance is a new option for vendors, and will give the new owner 90 days to make the pool compliant. Like a certificate of compliance, it will be generated from the Swimming Pools Register.
